The petitioner apprehends his arrest in a criminal prosecution registered under Section 307 and some other allied offences under the Indian Penal Code.
Though the petitioner is named in the FIR vide Annexure-1 as an accused, but taking into consideration the fact that the allegation against him is general and omnibus in nature and further taking into consideration the fact that, on close of investigation, police submitted charge-sheet, but the petitioner was not sent up for trial, but the learned Magistrate disagreed with the police report and took cognizance against him also, this Court is inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail is allowed.
In the event of his arrest or surrender in the court below within a period of four weeks from today, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.11712 of 2016 (2) dt.18-03-2016 satisfaction of learned C.J.M., Samastipur in connection with Patori (Mohanpur O.P.) P.S. Case No. 39 of 2014, subject to the conditions under Section 438(2) Cr.P.C.
