Mr.Mithlesh Kumar Khare ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL ORDER 16-12-2022 This matter is heard through video conferencing. The petitioner has filed regular bail petition under Sections 439 and 440 of the code of Criminal procedure. He is involved in Triveniganj P.S. Case No. 12 of 2022 registered for the alleged offences under Section 25(1-B) a/26/35 Arms Act. The alleged offence is stated to have been committed on 05.01.2022 at around 01.40 P.M. During the search, based on source information police have recovered one country made pistol from the left side of waist of accused petitioner and one pulsar Motor-cycle of Bajaj Compnay without any registration number. The aforesaid alleged offence is stated to have been committed by the petitioner and he is not involved in any other case. Investigation and further proceedings would take sufficient time and the fact that the petitioner is involved in an isolated case. Hence he is entitled to regular bail.

No.50736 of 2022(2) dt.16-12-2022 2/2 In the light of these facts and circumstances the petitioner to be released on bail on furnishing bail bond of Rs. 10,000/- to the satisfaction of learned Distt. and Session Judge Supaul in connection with Tribeniganj P.S. Case No. 12 of 2022 subject to the following conditions.
1. The petitioner shall co-operate in investigation and in conclusion of the trial.
2. He shall remain present on each and every date of trial till conclusion of trial.
3. He shall not try to tamper with the evidence or intimidate the witness to delay the conclusion of trial.
4. In the event of default of two consecutive dates without any valid reasons, his bail bonds is liable to be cancelled.
5. The Court below shall verify the criminal antecedent of the petitioner and in the case, at any stage, it is found that petitioner had concealed his criminal antecedent, the court below or investigating authority shall take immediate step for cancelling bail bond of the petitioner. However, acceptance of bail bonds, in terms of the aforementioned order shall not be delayed for this purpose or in the name of verification.
