====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Khajekalan P. S. Case No. 04/2024 in a case registered for the offences punishable under Sections 307, 506, 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, on the alleged date and time, informant received information that her husband has been shot near the graveyard and thereafter, he died during course of treatment. Informant suspects that all the F.I.R. named accused persons including 3-4 other persons killed her husband.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired
Patna High Court CR. MISC. No.51573 of 2025(2) dt.12-09-2025 2/2 during course of investigation on confessional statement of coaccused Md. Chand @ Aftab. Save and except the confessional statement, there is no other material on record to substantiate the allegation levelled against the petitioner. Petitioner is in custody since 19.12.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna City in connection with Khajekalan P. S. Case No. 04/2024.
