JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

It is alleged that during vehicle checking, the police intercepted the petitioner with one motorcycle and on being asked about ownership document the petitioner went away from the place of interception on the assurance that he is coming with the ownership document but in spite of several reminder he did not appear before the police. Thereafter, the police lodged the F.I.R. on 26.12.2014 against the petitioner.

It is submitted by learned counsel for the petitioner that from the F.I.R. it appears unreasonable that the police allowed the petitioner to go from the place of interception and prepared

Patna High Court Cr.Misc. No.13166 of 2015 (2) dt.01-04-2015 2/2 seizure list and registered F.I.R. after about a month of the actual seizure. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,Sitamarhi in connection with Bajpatti P.S. Case No.276 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
