2. The petitioner, Chairman of Primary Agriculture Credit Society, has invoked the jurisdiction of this Court for seeking protection of his life and property as he is working in an area suffering from the naxal activities. The petitioner relies upon report of the SubInspector submitted to the Senior Superintendent of Police recommending police help to the petitioner.

3. In the counter affidavit filed, it has been averred that the petitioner is relying upon an old case instituted at the instance of

Patna High Court Cr. WJC No.321 of 2016 dt.29-08-2016 2/2 his son which does not lead to a conclusion that there is immediate threat to the petitioner or to his godown. It is also averred that local police is constantly monitoring the godown as well as nearby places to look for miscreants or any suspicious activity but nothing transpired during such monitoring and that there has been no recent naxalite activity in the region.

4. In view of the averment made in the counter affidavit, I do not find that there is any threat perception which may entitle the petitioner for grant of police security.
