The petitioner seeks bail in connection with Nabinagar P.S. Case No. 35/2018 dated 11.02.2018 instituted for the offences under Sections 385 and 387 of the Indian Penal Code. The informant has alleged that while she was getting her house constructed in the absence of her husband, two persons on a motorcycle came and enquired whether she was the wife of one Birendra Singh. Later, her husband received a call on his mobile telephone asking to pay up Rs. 5 lakhs, or else his/her son would be kidnapped. The SIM Card, which was used for the aforesaid communication, was found to be standing in the name of one Dharmendra Kumar. Later, it transpired that the name of the holder of the SIM Card was fictitious and in fact, it was being used by others. In further investigation, it came to light that one Yamuna

Patna High Court Cr.Misc. No.35247 of 2018 (3) dt.06-07-2018 2/2 Kumar was involved in the occurrence. Aforesaid Yamuna Kumar has taken the name of the petitioner.

Thus, the learned counsel for the petitioner has submitted that his prosecution in the present case is only on the basis of confession of a co-accused. That apart, it has been submitted that no money was paid by the informant.

The petitioner does not have any criminal antecedent and is in custody since 20.02.2018.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S.
