This application for grant of anticipatory bail arises out of Alauli P.S. Case No. 18 of 2016, disclosing offences under Sections 467, 468, 471, 420 and 120B/34 of the Indian Penal Code.
The allegation against the petitioner is that she is secured her appointment as Panchayat Teacher on the basis of certificate issued by an institution, which was found to be fake. It appears that the petitioner's service has been terminated.
Considering the fact that the petitioner is a lady and there is no likelihood that she would flee away from the course of
Patna High Court Cr.Misc. No.17523 of 2016 (3) dt.29-06-2016 2/2 investigation or trial, this application is allowed. Let the petitioner, above-named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 18 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
