Petitioner apprehends arrest in connection with Barauni (Zero Mile) P.S. Case No. 135 of 2017 registered for the offence punishable under sections 406, 420/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been falsely implicated in this case. Petitioner is neither the lonee nor the dealer. Petitioner has no concern with the alleged money. Petitioner has no criminal antecedent.
Learned Addl. P.P. appearing for the State opposes
Patna High Court CR. MISC. No.7519 of 2021(7) dt.11-04-2022 2/2 the prayer for bail and submits that petitioner during investigation materials have coming showing complicity of this petitioner in the alleged occurrence and witnesses have taken the name of the petitioner. Petitioner, therefore, does not deserve to be granted the privilege of bail. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
