The petitioner apprehends his arrest in Udwant Nagar P.S. Case No. 398 of 2014 pending before Chief Judicial Magistrate, Bhojpur, Ara, registered for the offences punishable under Sections 341, 323, 325, 307, 504 of the Indian Penal Code. Allegation against the petitioner is that he dashed his own brother and thrown his own niece from the roof of the house.

Learned counsel for the petitioner submits that injuries are simple in nature. Petitioner is own brother-in-law of the informant. On account of some family dispute this case has been lodged.

It appears that informant made specific

Patna High Court Cr.Misc. No.8380 of 2015 (2) dt.02-03-2015 allegation that firstly petitioner dashed her husband and thereafter threw the daughter of the informant from the roof of the house.

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the same is rejected. Rajeev/- (Prabhat Kumar Jha, J.) U T
