Versus
The State of Bihar & Ors .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Dineshwar Pandey For the Respondent/s : Mr. Gp10-Kumari Amrita ====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 10-03-2016 Heard the learned counsel, Mr. Ashok Kumar Garg, for the petitioner.
From perusal of the order dated 07.01.2015 passed by Munsif Ist, Civil Court, Sasaram in Title Suit No.26 of 2010 which is impugned in this application under Article 227 of the Constitution of India. It appears that the learned Court below considering the facts and claims of the parties recorded finding that it is desirable that the intervener should be made a party as he is claiming title to the suit property and challenging the adoption of the present petitioner.
In view of the above factual position that the Court below has recorded finding that the intervener is necessary party, no case for interference in supervisory jurisdiction is made out. Accordingly, this writ application is dismissed. Sanjeev/- (Mungeshwar Sahoo, J) U
