2. Petitioner seeks regular bail in a case registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, total 110 liters of illicit liquor was recovered from the seized CNG Auto.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is named in the FIR rather, his name came up in the statement of local people. No incriminating material has been recovered from the conscious possession of the petitioner, and he has got no concern with the aforesaid

There is no specific allegation, and co-accused Tulsi Kumar has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 09.06.2026 passed in Cr. Misc. No. 36163 of 2026. The petitioner has got one criminal antecedent, similar in nature in which he is on bail. Petitioner is in custody since 06.06.2026.

5. Learned A.P.P. for the State vehemently opposes the regular bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the regular bail application is allowed. Let the above named petitioner be released on bail, on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna City in connection with Malsalami PS Case No. 211 of 2026.
