JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 394 of the Indian Penal Code.

As per the prosecution case, two motorcycle borne unknown miscreants overpowered the informant, whereas one of them inflicted iron rod blow on his head. Thereafter, accused persons looted cash of Rs.1.5 lacs, Laptop, 5 ATM cards, Pan Card, Aadhar card, votor ID, CSP agreement paper and fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got clean

Patna High Court CR. MISC. No.60459 of 2021(2) dt.11-02-2022 2/2 antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 24.5.2021.

Learned counsel for the State opposes the prayer for bail and submits that during course of investigation, stolen Aadhar card of the informant as well as ID proof of his wife have been recovered from the possession of the petitioner. Considering the nature of accusation against the petitioner, his prayer for bail is refused.
