The petitioner has filed the writ application for the payment of difference amount of G.P.F. after re-calculation and also for the interest.
Counter affidavit has been filed on behalf of the respondent nos. 5, 6 and 4. In the counter affidavit, the petitioner has admitted that the G.P.F. amount has already been paid. The Authority Slip was issued on 13.08.2005 for Rs. 3,91,740/-, but the payment is made on 09.04.2007 amounting to Rs. 3,77,940. The rest amount of G.P.F. has been paid vide
Patna High Court CWJC No.1745 of 2017 dt.03-07-2019 2/2 Authority Slip issued on 26.08.2016 for Rs.23,307/- and actual payment was made on 04.07.2018. The interest has been paid up to 2005.
The petitioner has submitted the judgment reported in 2016(4) PLJR 629 (Uday Shanker Prasad vs. The State of Bihar and others. From the fact, it is clear that the G.P.F. amount has been paid on delay. It is not part of the petitioner. Accordingly, I direct the respondent-State to ensure the payment of the interest occasioned by delayed payment by G.P.F. within one month from the date of receipt/production of a copy of this order.
With this observation, this writ application stands disposed of.
