2. Petitioner seeks regular bail in a case registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, total 100 liters of illicit liquor was recovered from an open place.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner, and he has got no concern with the aforesaid recovery. The petitioner was not arrested on the spot, and his name was disclosed by the local

Patna High Court CR. MISC. No.50195 of 2026(2) dt.22-07-2026 2/2 people. The petitioner has got four criminal antecedents, three of which are similar in nature in which he is on bail. The petitioner is in custody since 04.05.2026.

5. Learned A.P.P. for the State vehemently opposes the regular bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the regular bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exlusive Special Court of Excise, Patna City in connection with Malsalami PS Case No. 317 of 2026.
