The petitioner seeks bail in connection with Begusarai Town P.S Case No. 639 of 2017, registered for the offences punishable under Sections 147, 149, 153, 295, 337, 353, and 427of the Indian Penal Code.
At the very outset, on behalf of petitioner it has been submitted that in this case similarly situated co-accused Sanjay Singh @ Funnu Singh and Raja Bahadur Singh @ Babu Saheb @ Babu Saheb Singh @ Ravi Shankar Singh have been allowed pre-arrest bail by another co-ordinate bench of this Court by order dated 28.06.2018 vide Cri. Misc. No. 32715 of 2018 and the petitioner having no criminal antecedent is
Patna High Court Cr.Misc. No.37050 of 2018(2) dt.29-06-2018 2/2 suffering in custody since 07.05.2018 and, as such, he deserves sympathetic consideration.
Learned A.P.P. fairly submits that other two coaccused have been allowed bail. In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No. 639 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
