2. The petitioners apprehend their arrest in connection with Kateya P.S. Case No. 374 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 109(1), 118(1), 352, 351(3), 3(5) of the BNS, 2023.
3. Allegedly, when the protest was made by the mother of the informant against selling of illicit liquor by coaccused Ramu Bin, all the accused persons variously armed surrounded the whole family of the informant and brutally

It is specifically alleged that on account of assault being made by co accused Ramu Bin, the mother of the informant sustained head injury. When the sister of the informant came to rescue her mother, she was also assaulted due to which she sustained a fracture injury in her hand.

Learned Advocate for the petitioners taking this Court through the FIR contended that the entire allegation revolves around co-accused Ramu Bin, who has been accorded the privilege of regular bail, as is evident from the impugned order. So far the allegation against the petitioners is concerned, besides the same being general and omnibus, instituted after a delay of 12 days, that too, without any explanation. The petitioners bear some criminal antecedent; however it is said that the same has been instituted on account of land dispute between the same parties. So far petitioner no. 4 is concerned he has no criminal antecedent.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that because of assault being made, the sister of the informant has sustained a grievous injury.
6. Regard being had to be submission made on behalf of the parties and considering the omnibus nature of allegation,

No.50219 of 2025(3) dt.18-11-2025 3/3 coupled with delay in lodging of the FIR, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-VIth, Gopalganj in connection with Kateya P.S. Case No. 374 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
