2. Petitioner seeks regular bail in connection with Phulwaria P. S. Case No. 266/2018 in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with other F.I.R. named accused person, killed informant by setting her on fire, owing to the land dispute.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to land dispute. Specific accusation of setting informant on fire by pouring kerosene is against co-accused Samarajiya Devi. Petitioner is only alleged to have assaulted informant. In the
Patna High Court CR. MISC. No.55940 of 2024(3) dt.18-10-2024 2/2 post-mortem report, no external injury was found on the body of deceased. Petitioner is a lady having clean antecedent and she is in custody since 11.05.2024.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Phulwaria P.
