The petitioners apprehend their arrest in Laxmipur P.S. Case No. 99 of 2007, registered for the offences punishable under Sections 307, 412 and 34 of the Indian Penal Code and under Sections 25(1-B)A/26/27/35 of the Arms Act.
The police on secret information went to the place of occurrence and arrested Rabindra Yadav with one loaded country made pistol and empty cartridges with one motorcycle bearing Registration No. WB-38K-3410. Rabindra Yadav disclosed the name of his accomplices as Gulabi Yadav and Dharmendra @ Dharma Paswan.
Learned counsel for the petitioners submits that the petitioner is not named in the FIR. Name of the petitioners was not
Patna High Court Cr.Misc. No.5803 of 2015 (2) dt.12-02-2015 2/2 disclosed by the accused who was apprehended on the spot. After six years of the occurrence, the confessional statement of one of the co-accused was recorded, who is said to have disclosed the name of the petitioners.
Considering the facts aforesaid the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 99 of 2007, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
