2. The petitioner seeks bail in a case registered for the offences under Sections 147, 148, 149, 323, 324, 307, 302, 447, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
3. As per F.I.R., 8 named and 3-4 unknown persons fired upon father of the informant, as a result of which father of the informant died and thereafter this petitioner also fired upon
Patna High Court CR. MISC. No.51064 of 2025(3) dt.02-12-2025 2/3 grandfather of the informant and the bullet hit the stomach of the grandfather of the informant.
4. Learned counsel for the petitioner submits that the F.I.R. is falsified by the post mortem report. As per post mortem report, only one firearm injury has been found on the person of the deceased whereas in the F.I.R. it is alleged that 8 named and 3-4 unknown persons fired upon father of the informant. He further submits that as per F.I.R., this petitioner fired in the stomach of the grandfather of the informant, whereas in the injury-report and the post mortem report, no firearm injury was found in the stomach of the grandfather of the informant. As per post mortem report, he died after two months of occurrnce due to septicaemia. Petitioner has got clean antecedent and is in custody since 23.11.2024.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposes the prayer for bail and submitted that petitioner is named in the F.I.R. and there is specific allegation against the petitioner that he fired upon grandfather of the informant.
6. Considering the aforesaid facts and circumstances, post mortem report and report of both the deceased as well as period of custody, let the above named petitioner be released on
Patna High Court CR. MISC. No.51064 of 2025(3) dt.02-12-2025 3/3 bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned J.M. 1st, Vaishali in connection with Raghopur P.S. Case No. 248 of 2021.
