JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-04-2016 The petitioner being husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 302/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after about twelve years of marriage. The dead body of the daughter of the informant was recovered with injuries from the well.
It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence and accidentally the victim fell in the well and she died due to drowning.
Learned A.P.P, after going through the case diary submits that the witnesses have suggested that accused persons after making assault pushed the victim into the well.
Patna High Court Cr.Misc. No.11547 of 2016 (3) dt.20-04-2016 2/2 It is submitted by learned counsel for the petitioner that informant has subsequently retracted from the initial version and has filed a petition to that effect before learned Court below.
Considering the aforesaid fact, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jhajha P.S. Case No. 151 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Jamui.
With the observations above, the application stands disposed of.
