JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 341/354/354B/506 of the Indian Penal Code and Section 66 of the I.T. Act. Though allegation against the petitioner, who is Proprietor of a computer institute, is that he is in the habit of loading photographs of the girl students on the face book even sexual coloured picture. Specific allegation is of identical act against the daughter of the informant.

Submission is that the matter appears to be of love-affairs between the two that is why statement of the victim has not been recorded by the police. The photographs produced would reveal that the pictures were shot voluntarily by the

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Triveniganj P.S. Case No.149 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
