The petitioner seeks bail in a case registered for the offence punishable under Sections 302/201/34 of IPC. Allegation against accused including the petitioner is to have killed the deceased and disposed of her dead body. It is submitted that the petitioner is the elder brother of the husband of the deceased and there has been partition among the brothers and he has no cause to kill the deceased. During investigation, the witnesses have stated that there was quarrel between the deceased and her husband. There is no evidence that the petitioner has committed any overtact. However, charge-sheet
Patna High Court Cr.Misc. No.47233 of 2014 (3) dt.20-03-2015 2/2 has already been submitted and there is no chance of tampering with the witnesses.
Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-7, Begusarai/court concerned in Samho P. S. Case No. 7 of 2014 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
