JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 302, 201 and 34 of the I.P.C.

Chandrakala Devi daughter of the informant was married with Bablu Jha fifteen years ago and she was blessed with two sons and one daughter aged about 12 years, 10 years and 5 years. The in-laws used to abuse and assault her for which panchayati was also held but they did not agree with the terms of panchayati and daughter of the informant was being assaulted and on 07.04.2014 she was killed and her dead body has also been made traceless.

Patna High Court Cr.Misc. No.48972 of 2014 (2) dt.30-04-2015 2/2 Submission is of false implication and that the petitioners have no concern with the family affairs of the deceased and her husband and they are living separately since long. There is no specific allegation against them and they are Gotnis of the deceased and as such they deserve sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.

In the facts and circumstances as stated above, considering that against the petitioners there is no specific allegation and they are claiming to live separately and as such the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. A.C.J.M. Begusarai in Samho P.S. Case No. 07 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
