The petitioner is in custody since 17.08.2017 in connection with Bodhgaya P.S. Case No. 21 of 2016 for the offence registered under Sections 25 (1-B)1-A, 26/35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner was not arrested with any arms rather on the basis of the confessional statement made before the police by co-accused the petitioner has been taken into custody.
Considering the aforesaid facts and circumstances of the case and that there is no recovery from the possession of the petitioner, let the petitioner, above named, be released on bail on
Patna High Court Cr.Misc. No.36628 of 2018 (2) dt.06-07-2018 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S. Case No. 21 of 2016.
