Petitioner being Panchayat Sewak is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420, 34 of the I.P.C. It is alleged that in the purchase of solar lights a sum of Rs. 10,17,600/- was misappropriated as the purchase was made at higher price than the price fixed by Breda or Beltron.

It is submitted by learned counsel for the petitioner that the purchase was made prior to the year 2010 but the First Information Report was registered in 2014. Moreover the solar lights were of Tata B.P. Company, a government approved company and considering the same the panchayat Mukhiya has been granted bail vide Cr. Misc. No.

Patna High Court Cr.Misc. No.7267 of 2015 (2) dt.03-03-2015 2/2 5144 of 2015.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dhansoi P.S. Case No. 124 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
