JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 31-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Chandi P.S. Case No. 279 of 2015 registered under Sections 147, 148, 149, 452, 380, 354-A, 506 of the Indian Penal Code and Section 3/4 of the Prevention of Witch (Daain) Practices Act, 1999.

It is contended that for an occurrence alleged to have

No.13771 of 2016 (2) dt.31-03-2016 2 / 2 taken place on 25th July, 2015, a complaint was filed on 31st July, 2015 which was referred to the police for investigation under Section 156(3) CrPC pursuant to which the FIR was instituted on 15th September, 2015. It is further contended that no occurrence as alleged did ever take place and the petitioners have been implicated in the present case due to enmity existing from before between the parties.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi P.S. Case No. 279 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
