JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467 and 468 of the Indian Penal Code.
The accusation against the petitioner is of receiving Rs. 25,000/- for providing government employment to the informant and others.
It is submitted by learned counsel for the petitioners that on conclusion of the investigation, the petitioners were not sent up for trial, but differing with the final form, cognizance was taken on 17.04.2007. Moreover, with similar accusation a complaint was also filed which stood dismissed.
Considering the fact that the FIR was lodged in the year 2002 and cognizance was taken in the year 2007, this Court is not
Patna High Court Cr.Misc. No.6143 of 2015 (2) dt.16-02-2015 2/2 inclined to interfere.
Let the learned court below consider the prayer for regular bail of the petitioners without being prejudiced by the order of this Court if they surrender within a period of six weeks in connection with Taraiyan P.S. Case No. 08 of 2002 pending in the court of learned SDJM, Saran.
Accordingly, the application is disposed of.
