JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Muffasil P.S. Case No. 89 of 2018 for the offense under Sections 25(1-B)A/26/35 of the Arms Act and Section 30 (a) of the Bihar Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He also submits that similarly circumstanced other co-accused have been granted anticipatory bail, namely, Munna Yadav vide order dated 01.05.2018 in Cr. Misc. No. 26714 of 2018, Dheeraj Kumar vide order dated 10.05.2018 in Cr. Misc. No. 28804 of 2018 and Mantun Yadav @ Mantun Kumar vide order dated 15.05.2018 in Cr. Misc. No. 29625 of 2018 have been granted anticipatory
Patna High Court Cr.Misc. No.36739 of 2018(2) dt.28-06-2018 2/2 bail.
Considering the fact that other co-accused have been granted anticipatory bail by the co-ordinate Bench of this Court and petitioner has no criminal antecedent, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction Addeitional Session Judge-II cum Special Judge Excise Act, Begusarai in connection with Muffasil P.S.
