The petitioner has prayed for bail in a case registered for the offence punishable under sections 395 and 397 of the Indian Penal Code and section 27 of the Arms Act. Prosecution case in nutshell is that the informant and his son went for purchasing articles for the purpose of marriage of his son, in the meantime, there were some unknown accused persons who snatched money from them and they also fired upon the informant and his son due to which they sustained injury.

It is submitted by learned counsel for the petitioner that petitioner is innocent and committed no offence. He has falsely been implicated in this present case. The petitioner has

It is further submitted that name of the petitioner came into light only on the basis of his self confessional statement. He is languishing in judicial custody since 23.03.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMVII, Sitamarhi in connection with Sonbarsa P.S. Case No. 36 of 2022.
