The petitioner has prayed for regular bail in a case instituted for the offence under Section 306 of the Indian Penal Code and Section 67 of the I.T. Act. It is a case of abatement of suicide. It is alleged against the petitioner that he always used to torture the daughter of the informant and got the photographs of the victim viral on social media, as a result of which, she committed suicide.

There is no evidence on record to suggest that petitioner had uploaded the photographs of the victim on social media. Moreover, the informant has filed a petition before learned Court below to the effect that F.I.R was lodged against the petitioner due to misinformation. The petitioner is languishing in judicial custody since 19.05.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In contra, learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction
