2. In this case, the petitioner is seeking regular bail in connection with Sabour P.S. Case No. 35 of 2024, registered for the offences punishable under Sections 399, 402, 414 of the IPC and under Sections 25(1-b)a, 26, 35 Arms Act. 3.As per allegation, on the basis of a secret information, the informant reached at the place of occurrence wherefrom five persons were arrested. The petitioner was also apprehended and during search one country made pistol, three live bullet and Rs. 4500 cash and one motorcycle has been recovered from the possession of the petitioner.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.54854 of 2024(2) dt.20-08-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is under custody since 28.01.2024 for the alleged allegation of recovery of a country made pistol, two cartridges and Rs. 4500/-.

5. On the other hand, learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances as well as period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 35 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
