Learned counsel, appearing for the petitioners points out that the petitioner Nos. 1 & 3 were granted privilege of anticipatory bail by this court vide order dated 10-03-2015 with direction to him to surrender before the court below within four weeks from the date of receipt/production of copy of order but as a matter of fact, another case was pending against the aforesaid petitioners and that was the reason, the accused persons could not surrender before the court below within the stipulated time and, therefore, petitioners need some more time to surrender before the court below.

In my view, petitioners should file a separate

Patna High Court Cr.Misc. No.9409 of 2015 (3) dt.07-04-2015 miscellaneous petition for the aforesaid prayer. Accordingly, the office should not list this matter again.
