NILU AGRAWAL ORAL ORDER 07-01-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of the Accountant General, Bihar, Patna.

Petitioner who retired from the post of Clerk from the office of the Circle Officer, Baheri, Darbhanga w.e.f. 31.01.2014 claims payment of his retiral dues such as pension, gratuity, commutation of pension amount, group insurance, G.P.F. and Earned Leave.

Learned counsel on behalf of the State has filed a counter affidavit on behalf of the respondent nos. 3 and 6 wherein Annexure-B has been enclosed stating therein in para 8

Patna High Court CWJC No.1496 of 2017(3) dt.07-01-2019 2/2 that retiral benefit amount have been sanctioned and some of it has been paid.

Learned counsel for the petitioner submits that in spite of sanction under various heads, he has not received payment as yet.

Considering the submissions of the parties, this writ application is disposed of with a direction to the respondent no. 3 to look into the claim of the petitioner who would file a representation enclosing Annexure-B which has been filed with the counter affidavit and the same would be disposed of within a period of two months from the date of such representation. Any payment due to the petitioner would be paid within one month thereafter. If certain dues are inadmissible as claimed by the petitioner, the same shall be disposed of by speaking order, communicated to the petitioner through registered post. (Nilu Agrawal, J) devendra/- U
