JUSTICE MOHIT KUMAR SHAH ORAL JUDGMENT Date : 28-02-2024 The present writ petition has been filed for quashing the memo of charge dated 31.1.2017, which has been issued and served upon the petitioner, asking him to submit his clarification, to which the petitioner has already submitted his clarification on 10.9.2018.

It is submitted that though by the aforesaid letter dated 31.1.2017, the departmental proceeding in question has been initiated, after retirement of the petitioner, on 30.6.2014,

Patna High Court CWJC No.18030 of 2021 dt.28-02-2024 2/2 nonetheless, the departmental proceeding in question has not stood completed till date, hence, it be directed that the same be concluded within a stipulated time frame.

The learned counsel for the Respondent-State submits that in case, the aforesaid departmental proceeding in question has not yet been concluded, by passing of the final order, the same would be done, within a stipulated time frame, as is prescribed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the disciplinary authority to take a final decision in the aforesaid departmental proceeding in question, in case the same is still pending, within a period of three months of receipt / production of a copy of this order, failing which the aforesaid departmental proceeding in question shall stand abated.

5.

The present writ petition stands disposed off on the aforesaid terms.
