The petitioner apprehends her arrest in Sidhwaliya P.S. Case No. 120/15 registered under Sections 420, 406 of the Indian Penal Code.

The present case is lodged by the informant, a Programme Officer, Barauli, Gopalganj, on the basis of the enquiry held by the Deputy Development Commissioner in pursuance of the order passed by this Court. It is submitted that the petitioner is a Mukhiya and she has no role in issuing job cards. Job cards are issued by the Panchayat Secretary and Programme Officer. There is nothing on the record to show that the petitioner issued any job card to any of the labour. It is submitted that in the enquiry held by the authority, no amount was found to be embezzled.

No.11362 of 2016 (3) dt.21-06-2016 2/2 Considering the facts aforesaid, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Gopalganj in Sidhwaliya P.S. Case No. 120/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
