Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 329(3), 126(2), 115(2), 352, 351(2), 109 and 74 of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is alleged to have assaulted the injured on head by an iron rod causing injury. 4.
It is next submitted that the petitioner and the informant are neighbours and an altercation had taken place on account of dispute relating to passage in which both sides assaulted each other. It is also submitted that even presuming
Patna High Court CR. MISC. No.49487 of 2025(3) dt.23-09-2025 2/2 what has been alleged is true without admitting, then the injury suffered by the injured is simple in nature and petitioner is not a criminal.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gopalganj P.S. Case No. 377 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
