JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with G.O. Case No. 69 of 2013 registered for the offence punishable under Section 47 A of the Excise Act.
Taking into consideration that in huge quantity foreign liquor as well as country made liquor have been recovered from the house of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with G.O. Case No. 69 of 2013 corresponding to Trial No. 4323 of 2013 pending in the court of Judicial Magistrate 1st Class, Madhubani stands rejected. However, if petitioner surrenders before the
Patna High Court Cr.Misc. No.10769 of 2015 (3) dt.31-03-2015 concerned court within four weeks from today and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order, particularly, keeping in mind the pleas raised by the petitioner before the trial court.
