Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of Arms Act.

The FIR of the occurrence of murder is against unknown. There is no suspicion against anyone disclosed in the FIR.

Submission is that name of the petitioner surfaced during investigation to be under suspicion, to have committed the murder. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 24.08.2017.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two

Patna High Court Cr.Misc. No.34833 of 2018 (2) dt.19-06-2018 sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Case No.97 of 2018 arising out of Kharagpur (Shampur) Police Station Case No.126 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
