====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 31.10.2017, seek bail in Akbar Nagar PS Case No. 90 of 2017 S.Tr. No. 167 of 2018 registered under Sections 25(10a), 25 (1-AA), 25(1-B)a, 26 and 35 of the Arms Act.

The allegation in brief is that on secret information the police raided diara area of the Ganges field, apprehended several persons on one spot where mini gun factory was being operated and large number of unfinished arms and instruments for making arms were recovered from the spot.

Learned Counsel for the petitioner submits that the FIR and the investigation discloses the fact that mini gun factory was being run by one Prasadi Mandal and Sukhdeo Mandal, the petitioners were engaged as labourers, both petitioners have been in custody for last eight months,. Investigation is complete but still charge has not been framed and the petitioners have no criminal antecedent. Having considered the said facts and circumstances, the petitioners, namely, Md. Mubarak @ Mistar @ Md. Mobarak and Md. Shaukat are directed to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.35089 of 2018 (2) dt.28-06-2018 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge lst, Bhagalpur in connection with Akbar Nagar PS Case No. 90 of 2017 S.Tr. No. 167 of 2018.
