JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 323, 324, 341, 307, 379 and 34 of the Indian Penal Code.
The allegation against the petitioner and other coaccused is of attacking the informant while he was returning home by his motorcycle with knife causing injury on his jaw and looting Rs. 10,000/- It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. It is further submitted that at best a case under Section 326 IPC is made out and no offence u/s 307 IPC is made out taking into account the weapons
Patna High Court Cr.Misc. No.11151 of 2016 (2) dt.25-04-2016 2/2 used in course of occurrence.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/arrest in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in Chapra Mufasil P.S.Case No. 12 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
