Petitioner apprehends his arrest in a case instituted under Sections 467/468/471/420/120(B) of Indian Penal Code. The petitioner alleged to have transferred the land in the year 2014 which his grand mother had already transferred in the year 1990. It is further alleged that the land was in the name of his grand mother.

The petitioner submits that he was unaware that the land was transferred by his grand mother.

It goes without saying that any transfer without authority of law would be void and no title would accrue on that basis. Having regard to the facts and circumstance of the case,

Patna High Court Cr.Misc. No.11341 of 2016 (2) dt.16-03-2016 2/2 in case of arrest/surrender, let the petitioner named above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Jamui, in connection with Jamui P.S. Case No. 294 of 2014 with the condition that he would not physically absent for two consecutive dates at a stretch, till three witnesses are examined in the trial, failing which his bail bond would be cancelled.

The learned court below is also directed to ensure completion of the trial preferably within one year from the date of receipt of a copy of this order.
