JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-07-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as informant. Petitioner is in custody in connection with Balua Bazar P.S. case No. 5 of 2018 for the offence under sections 302, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is driver of the bus. The petitioner is in custody since 18.01.2018. Learned counsel appearing on behalf of the informant submits that it is true no one has seen the real occurrence but the petitioner was found last seen with the victim. Learned A.P.P. on the basis of case diary submits that against this petitioner except last seen there is no other material to indicate any involvement of the petitioner in the present case.

No.35978 of 2018(3) dt.25-07-2018 2/2 In view of the above, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Supaul, in connection with Balua Bazar P.S. Case No. 5 of 2018.
