1. Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State.

2. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 406, 420, 120B of the Indian Penal Code.

3. It is alleged that the petitioner snatched the ATM of the informant on false pretext of Bank Officer and withdrew Rs. 50,000/- from his account.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 27.06.2022, the F.I.R was registered on 01.07.2022 without

Patna High Court CR. MISC. No.54064 of 2023(3) dt.20-09-2023 2/2 explaining the delay. The petitioner was not apprehended from the spot. Nothing was recovered from the conscious possession of the petitioner. The petitioner was arrested in Darbhanga Town P.S. Case No. 51 of 2023 and thereafter he was remanded in the present case. The petitioner has still not been put on T.I.P. Moreover, he is languishing in custody since 25.03.2023.

5. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned concerned Court in connection with Ashok Paper Mill P.S. Case No. 113 of 2022.
