JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 456,380 and 511 of the Indian Penal Code.

It is alleged that in the night of 25.10.2013 the informant being Junior Engineer of Irrigation Department received an information that some mischief is being done in the quarter when he saw this petitioner removing the door and it was suspected that the petitioner attempted to commit theft. It is submitted by the learned counsel for the petitioner that for the occurrence of 25.10.2013 the FIR was registered on 28.10.2013 which reached the court on 30.10.2013 which suggests antedating of the FIR. Statement has been made in paragraph 3 of

Patna High Court Cr.Misc. No.46289 of 2014 (2) dt.16-04-2015 2/2 the petition that the petitioner has no criminal antecedent. More over, the petitioner had a quarrel with the informant at earlier point of time.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Araria (R.S.) P.S. Case No. 489 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
