JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the informant's son performed intercaste marriage which was not being liked by the accused persons as a result, the FIR named accused persons including the petitioner came when Mochi Sharma caused firearm injury on the neck of the informant's son.

It is submitted by learned counsel for the petitioner that the overt act has not been alleged against the petitioner and the petitioner has been made accused in one other case after institution of the present case.

Considering the fact that no overt act is alleged against

Patna High Court Cr.Misc. No.9577 of 2015 (2) dt.11-03-2015 2/2 the petitioner, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway J.M., Gaya in connection with Rail Sasaram (G.R.P.) P.S. Case No. 46 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
