JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Khajauli P.S. Case No. 169 of 2012 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code, 3⁄4 of Prevention of Damages to Public Property Act and 27 of the Arms Act.

Taking into consideration that petitioner is not named in the first information report and one co-accused, who was figured in the first information report, has already been granted privilege of anticipatory bail by a co-ordinate bench of this court, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks

Patna High Court Cr.Misc. No.7292 of 2015 (2) dt.23-02-2015 from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Atul Veer Singh, Judicial Magistrate 1st Class, Madhubani in Khajauli P.S. Case No. 169 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
