The petitioners being brother and brother's wife of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 498A, 304B, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Prosecution case is of killing the daughter of the informant within two years of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners and the thrust of accusation is against the husband of the victim, who has been granted

Patna High Court Cr.Misc. No.15290 of 2016 (2) dt.06-04-2016 2/2 anticipatory bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.35/2016 while parents of the husband of the victim have been granted anticipatory bail vide Criminal Miscellaneous No.57829/2015.

Considering the fact that accusation is omnibus and general and the husband of the victim has been granted anticipatory bail by a co-ordinate Bench of this Court, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad, in connection with Aurangabad Town P.S. Case No.407/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
