JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Gwalpara P.S. Case No. 14 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 349, 504, 506 of IPC.

Prosecution story as per the F.I.R. is that petitioners and other accused persons variously armed, started abusing the informant, when he protested the petitioner no.1, assaulted by rod on the head, when his son, grandson and wife came to save them, they assaulted them also.

Submission of the learned counsel for the petitioners is that except petitioner no.1 there is no allegation attributed

Having heard both sides, in view of the facts and circumstances, as stated above, so far as, petitioner no.1 is concerned, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, he may surrender before the learned court below and make prayer for regular bail. So far as other petitioners are concerned, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Sri Shiv Kumar, Judicial Magistrate, 1st Class, Mdhepura, in connection with Gwalpara P.S. Case No. 14 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
