JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-09-2023 The present petition has been filed for modification of the order dated 01.12.2022 passed in Cr. Misc. No. 38538 of 2022 to the extent of extending the period of surrender.

It is submitted by learned counsel for the petitioners that petitioners could not surrender on time since the order was not communicated on time by petitioner No. 1 who was handling the case and was

Patna High Court CR. MISC. No.61070 of 2023(2) dt.22-09-2023 2/2 outside State for his livelihood.

Considering the fact that anticipatory bail of the petitioner was allowed on 01.12.2022 whereas the present modification petition has been filed 05.09.2023, this Court is not inclined to modify the order 01.12.2022 passed in Cr. Misc. No. 38538 of 2022.

Accordingly, the petition stands dismissed.
