The petitioner, in the present case, is seeking regular bail in connection with Bangaon P.S. Case No.141 of 2017, registered for offences alleged under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Nothing incriminating has been recovered from his possession. No Test Identification Parade has been conducted. It is further submitted that the name of the petitioner has transpired in the confessional statement of coaccused Prakash Kumar who has been granted bail by a learned coordinate Bench of this Court vide order dated 28.05.2018 passed
Patna High Court Cr.Misc. No.37288 of 2018 (2) dt.29-06-2018 in Cr. Misc. No.27360 of 2018.
Learned APP for the State is present.
Considering the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Saharsa in connection with Bangaon P.S. Case No. 141 of 2017, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
